| dc.description.abstract (摘要) | 少年事件處理法第一條規定該法目的是為了保障少年健全之自我成長，而調整其成長環境，並矯治其性格。有精神疾病之少年，往往因為其思考、情緒、知覺、認知、行為等精神狀態表現異常，致其適應生活之功能發生障礙，而需要給予必要的醫療及照顧。此類少年，因疾病與非行行為而帶來或彰顯出少年所面對的雙重不利益，如何考量其特殊的狀況與需求、如何調整其成長環境、如何矯治其性格，又應給予何種援助，各種顧慮與所需資源會比一般少年的問題更為複雜。在我國現行少年司法體制下，面對此種少年，如何才能夠落實少事法促進健全成長之目的，又長遠來說在體制上應該朝向何種改革目標，是無法忽視的問題。由於有精神疾病的非行少年可能涉及廣泛的問題，整體的規劃有待持續的努力而非一蹴可及，本研究計畫將先鎖定在非行少年的矯正處遇階段，避免問題射程過於廣泛，在研究面向上則同時進行理念的探討，及相關政策方案與制度的比較，以兼顧理論性與實用性。 | |
| dc.description.abstract (摘要) | The goal of Juvenile Delinquency Act, as described in Article I of the ACT, is to ensure a healthy development of the youth, using measures including changes of the living environment and corrections of their characteristics. Due to abnormality in terms of thinking, emotion, consciousness, cognition and behavior, the youth with mental illnesses often have difficulties in leading a normal live, thereby they demand proper medical treatments and care. The youth with mental illnesses suffer from double disadvantages caused by illnesses and delinquency, making it more complex to consider their specific conditions and needs, the proper adjustments of their living environment, the measures to correct their characteristics, and the help to be offered to them. Therefore, it is an inevitable task to design and carry out a reform of the existing Juvenile Justice system in order to fulfill the goal of the Juvenile Proceeding Act in the long run. Addressing the problems of the youth with mental illness may involve a wide range of issues, thereby a complete scheme requires continuous effort for a long period of time. To this end, in this proposed project I focus on the stage of correctional treatments, without considering issues taking place in other stages. Meanwhile, I will examine the stage of correctional treatments both theoretically by summarizing relevant theories, and empirically by comparing relevant public polices and institutional designs. | |
