| dc.description.abstract (摘要) | 在「數位經濟」或「資料驅動經濟」時代,個人資料保護法與競爭法的交錯問題,也就是「是否」以及「如何」透過競爭法的規範,確保消費者的隱私,同時促進「資料驅動事業」的競爭,近年來成為學理與實務上高度關注的議題。有鑑於國人普遍使用、且大量蒐集個人資料的數位服務平臺(如:臉書、谷歌、Line),往往具有相當的市場力,其是否藉由優勢市場地位,榨取使用者個人資料,侵害國人個人資料自主決定權利、甚至妨礙新進業者競爭?我國競爭法主管機關此時是否有必要介入調查?其與個人資料保護法(及主管機關)的關係為何?本研究計畫將參考美國、德國相關討論與案例,試圖釐清上述問題。 | |
| dc.description.abstract (摘要) | In the age of Digital economy and data-driven economy, the interplay of data protection and competition laws—whether and how to employ competition law to protect consumer privacy and enhance competition in data-driven businesses—have attracted high attention from both academia and relevant regulatory bodies abroad. In Taiwan, digital platforms, such as Facebook, Google and Line have acquired a huge market share in their respective market and collected vast amount of their uses’ personal data in their daily operation. This raises issues regarding whether these platforms have abused their dominant market power to exploitatively collect and use their uses’ data, violating uses’ right to information self-determination as well as impeding competition; Whether the Taiwan Fair Trade Commission should commence an investigation in this regard; and what is the relationship between Taiwan’s Fair Trade Act and Personal Data Protection Act? By comparing existing research and concrete cases in the U.S. and European Union, this research project tries to answer the above-mentioned questions. | |
