題名 論海平面上升所引起之海洋法與其他相關國際法議題

摘要 儘管精確預測海平面上升的程度在科學上存有爭論,但海平面上升的現象已無法被否認。由於嚴重威脅低地島國與沿海地區之生存、形成沿海國海岸線之變動,乃至於改變海洋與海岸地區地形、地貌與海洋漁業與其他生物之生存環境與棲息地,過去三十年來小島國家與沿海國家乃至於已開發國家和聯合國均已陸續對此議題呼籲國際社會的投入與採取相關因應措施。由於海平面上升對於傳統國際法與海洋法的衝擊,涵蓋國家領土與國家地位、強制性移民與人權保障問題、海洋法中的基線制度與海洋分區制度,牽涉的規範層面相當廣泛,而本研究計畫提出時礙於篇幅有限,僅處理部分海洋法議題,尤其是現行公約關於基線制度與海洋分區之條文中有文義不明之處,實在需要更通盤性的檢討與研究。而海平面上升所生之衝擊,不但涉及小島國家本身自然條件與經濟條件的問題以外,更由於此類國際法的規範設計使得小島國家在面對海平面上升的問題上更顯得脆弱。本研究計畫未來將不但需要再深入研究海洋法相關議題,亦需要再針對國家地位與人權問題作深入研究,以解答現行國際規範是否可以透過規範解釋解決爭議,或是需要形成新的國際規範以保障相關權益。
To precisely estimate how much the sea level would rise is arguable. However, the phenomenon of sea level rise cannot be denied, as sea level rise threatens the existence of small island states and coastal regions, the environment of coastal regions, and the marine habitats. In the past thirty years, small island states, coastal states, developed states and United Nations also called for the efforts of international society to face these problems. The problems resulted from sea level rise widely challenged the traditional concepts of public international law and law of the sea. In cases of the law of the sea, the baselines regime and the regulations of maritime zones are impacted by the rising sea level. This research project intends to examine the challenges of sea level rise to the law of the sea and public international law and answer how the regulations can be developed for these challenges.
