| dc.description.abstract (摘要) | 本計畫旨在探討「國家管轄範圍以外地區海洋生物多樣性」談判之海洋遺傳資源相關規範發展與形成，及其彼此間之相互作用。此涉海洋法、環境法和經貿法議題，除智慧財產權問題和規範外，《聯合國海洋法公約》和《生物多樣性公約》和其後續文件亦有相關規範，但卻無法有效適用於國家管轄範圍以外地區之海洋生物探勘活動。本計畫預計透過現有公約之分析和比較，以瞭解其瓶頸，作為比較之基礎；藉由研析談判草案有關條款，以瞭解海洋遺傳資源之規範；透過代表性國家之法制與實踐，以瞭解特定國家於談判中之立場與影響，進而形成對國家社會、經濟和環境之影響。故而透過本計畫將可深植相關規範領域之研究能量，促進國內海洋與生物科技政策和產業之發展。 | |
