| dc.description.abstract (摘要) | 國內大型公共工程採購案件，雖已漸採統包辦理招標，然卻常見採購機關對於契約概念尚屬陌生，致與一般傳統設計後施作契約相為混淆，工程會函頒「統包工程採購契約範本」供各界機關作為參考，雖幾經修正，然此範本之制定乃依據工程會的一般工程採購契約範本，參採統包特性而修正調整而來，並未如同國際工程慣例區分「設計建造」契約（Design and Build, DB）及設計建造與供應安裝統包契約(EPC/Turnkey)，則一體適用是否妥適，實有必要加以了解。甚而於司法實務，也有部分判決呈現悖於工程法理之見解，實值分析與釐清。
本計畫擬以三年時間，以工程會建置之「公共工程標案管理系統」為基礎，利用公共工程主管機關建置達15年及35萬筆之資料庫，了解設計建造統包契約之執行狀況，且針對衍生爭議之標案，以溯源方式辨識發生「變更設計」、「工期展延」與「技術服務爭議」之事由。另參照司法院建置之「法學資料檢索系統」、中央及各直轄市之採購申訴審議委員會「採購爭議處理進度查詢系統」進行查詢，並參考其他各國立法例及司法實務案例，就統包契約訴訟或調解案件之相關法律問題，包括契約條款及我國法制面向等，進行分析檢討，期能提供學界、業界及政府部門參考，以達減省採購成本與訟爭、提高採購品質與參標意願之效。 | |
| dc.description.abstract (摘要) | Design-Build(D&B)contracts are applied to public projects in recent years. However, it is often to find the employers are not familiar with the total accountability style of contracting. Some of them are confused with traditional Design-Bid-Build(D-B-B) contracts. PCC, as the highest authority of public projects, provides a model form for turkey contracts in 2009. Yet it is criticized that this model form is based on the traditional D-B-B model form, with minor modification. It differs from international construction practice, with separate model forms for D&B contracts and EPC turnkey contracts respectively. Even in the litigation practice, some of the holdings of the domestic courts are with big gaps with international construction practice. All of these situations need to be clarified.
This research is planned to be conducted in 3 years. The database of PCC, Public Construction Management Information System, in which with 350K projects in past 15 years, provides the primary information of public projects. It is hoped to identify the roots causing the disputes of variations, extension of time and technical services problems by reviewing the recorded facts of these projects. On the other hand, the Law and Regulation Retrieving System of the Judicial Yuan, and the Query System of Government Procurement Dispute Settlement of PCC, are the cross-check database to trace the outcomes of disputes. Next, it is needed to survey the practices of international construction law and leading cases as comparison. The final stage will be the conclusion summed up, to provide feedback to the academy, the industry and the authority. It is hoped the research contribute to reduce the costs and disputes it may occurs, and to improve the quality of public projects in the future. | |
