| dc.description.abstract (摘要) | 勞動事件法第4章，處理勞動訴訟中之保全程序問題。在現行民事訴訟法相關規定之外，勞動事件法特別針對三項議題：解僱保護訴訟程序中之繼續僱用請求權，裁決程序中及裁決決定作成後特殊之保全程序問題－包括以裁決決定代釋明之聲請，以及實務上常見之對勞工不利的雇主調動之暫時權利保護，均設有特別規定，相當程度不同於現行民事訴訟法規範，除了可預期對勞動事件審判產生一定程度的影響外，亦可能對於勞動實體法，特別是解僱、不當勞動行為、調動等，發生一定的牽引作用，特別是事由之告知、作成之程序等。 | |
| dc.description.abstract (摘要) | The Chapter 4 of the Labor Litigation Act deals with the issue of provisional remedies proceeding in labor litigation. In addition to the relevant provisions of the current Civil Procedure Act, the Labor Litigation Act specifically addresses three issues: the right to continue employment in the dismissal protection proceedings, the special procedural issues in the deciding procedure against the unfair labor practice and after the decision is made - including in stead of proving or indication the facts with the decision above for the application, and not the least the temporary rights protection of workers who under unfavourable jobs transfer subject to the order from employers, which are quite different from the current rules of Civil Procedure Act. Except that it can be expected to have a certain degree of impact on labor trials, the provisions of the Chapter 4 may has a certain traction effect on such as the labor substantive law, especially dismissal, unfair labor practice, jobs transfer, etc., especially with the procedure of notification and its causes. | |
