| dc.description.abstract (摘要) | 本計畫希望對於我國司法院大法官不受理決定、法院判決與大法官解釋後的個案判決救濟情況進行質性與量化的分析研究，了解各級法院於個案判決中，適用憲法，對法令進行釋義，建構個案當事人之基本權利內涵與範圍之情況與比例，一方面了解人民憲法上基本權利在一般法院受審理之實況，以杜絕透過片面印象而對司法實務產生的誤解，另一方面確認以保障人民基本權利為由，預計在我國現行違憲審查制度增加憲法裁判訴訟之必要性。另外，由於我國與法國相同都是採取集中抽象的違憲審查模式，因此本計畫將以法國2008年修憲增加事後違憲審查制度後的實務情況作為比較法的參考對象，尤其著重法國最高法院與最高行政法院如何在個案中進行QPC案件的篩選，以及憲法委員會如何與二個最高法院在人民基本權利保護的工作上進行分工，以作為我國未來擴大違憲審查範圍的參考。為在有限期程內達成研究我國法院判決對於基本權是否具備建構與鞏固功能之目標，本研究必須限縮基本權的研究範圍，因而以延續本人近年來的研究主題：平等權、居住權、性別與原住民作為篩選的標準，同時也將對照法國法院判決對於此四種標準的判決情況，以進行比較研究。 | |
| dc.description.abstract (摘要) | This project hopes to do a qualitative and quantitative analysis towards the cases of the dismissed decision of the Justices of the Judicial Yuan, the courts’ judgments and the judgment after the Justices of the Judicial Yuan’s interpretation and to understand the situation and percentage of the courts’ judgments which apply the
Constitution to interpret and establish the parties’ fundamental rights. On the one hand, this project hopes to understand the actual situation of how people's fundamental rights of the Constitution present in the cases of the courts and to prevent any misunderstanding of judicial practice through one-sided impressions. On the other hand, it is confirmed that the necessity of accept the “Verfassungsbeschwerde” system on the pretext of safeguarding the fundamental rights. Besides, it’s because Taiwan and France that all adopt the abstract and concentrated constitutional review, the project will take the actual situation after the retrospective constitutional review system which was added in France in 2008 as the reference of comparative law. | |
