| dc.description.abstract (摘要) | 本研究計畫之主旨在於：我國船員法之「船員」勞動保護之法律體系研究。嘗試以兩種比較途徑:國際法(2006海事勞動公約)與國內法之比較，以及我國法與日本法之比較模式，建構我國船員勞動保護之法律體系。並以法院相關船員勞動爭議之判決為基礎，根據不同權利之事項爭議進行相關案例之判決整理與分析，說明船員權利爭議之爭點以及法院援引實定法之論證途徑。整合各階段之研究成果，本計畫對於產生以下具體之影響：其一、完善與統整我國船員勞動保護之法律體系，使船員權利受到完善的保障。其二、有助於法院實務判斷此等案件時建立明確之判斷基準。其三、調整我國船員勞動現行有關不適宜之政策方向。 | |
