| dc.description.abstract (摘要) | CRPD的中心思想是以建置涵蓋各生活面向的輔助框架促進障礙者獨立自主，而 輔助決定制是輔助框架的一個核心成分。本計畫選擇精神衛生領域作為探討CRPD輔助決定制對內國法衝擊及因應措施的具體法領域，研究議題涵蓋兩大範疇：第一個範疇是如何將輔助決定制落實於精神衛生法脈絡，此間必須解決的子議題包括：1.應以何種方式與標準判斷精神障礙者有無自主決定能力；2.CRPD要求尊重障礙者意願與偏好之誡命，在精神衛生實務上可能遭遇之困境；3.精神衛生法保護人制度之檢討；第二個範疇是精神衛生法上強制措施實施要件與方式之檢討，具體要檢討的問題包括：1.強制住院之評估標準與實施程序應如何規範；2.強制住院與強制治療分開規定的必要性；3. 社區強制治療制度之檢討。本計畫擬先以文獻分析法形成解決上開各議題之初步構想，再藉由與實務界及利害關係人座談與交流，驗證與調整所構思方案之可行性。 | |
| dc.description.abstract (摘要) | Article 12 of the International Convention on the Rights of Persons with Disabilities (CRPD) states that persons with disabilities should have equal recognition before the law and the right to exercise their legal capacity. The Convention recognizes that some persons with disabilities require assistance to exercise this capacity. States must do what they can to support those individuals and introduce safeguards against abuse of that support. This means that States have a legal obligation to explore alternatives to substituted decision-making. The first major issue of this paper is how to apply the CRPD support framework under mental health law. The method to carry out this study is to review the legislation and research globally concerning supported decision making for persons with mental disabilities, from which to get inspiration of development of a CRPD-based support framework in the mental health context.
The second major issue of this paper concerns the question of whether compulsory admission and involuntary treatment of persons with mental disabilities is compatible with CRPD, and if so, in what circumstances. Questions raised by scholars and other commentators regarding the CRPD in the mental health context and Important practical issues will be considered. Based on a finely balanced analysis, this paper tries to propose mental health act revisions compatible with CRPD. | |
