題名 當代國際法上未被普遍承認主體之研究—從國內法地位與國際組織參與探討

摘要 現代國際法的主體雖已不限於國家,但國家仍為最重要的國際法人類型,而國家資格常為在他國國内 法上享有權利負擔義務以及參與國際組織的門檻,雖然一般認為國家的存在與否乃為事實問題,而國 家之要件不包括承認,但國際社會上未被廣泛承認的實體在與他國交往或國際組織的參與上卻仍常遇 到困難,難與其他國家平起平坐。本研究計晝希望從國内法地位及國際組織參與兩個角度來分析當代 國際法上未被廣泛承認國際法主體的地位。第一部分的研究以重要國家國内法為核心,雖然未被廣泛 承認的國際法主體在其他國國内法上通常享有的地位及權利義務範圍不同於一般國家,但現實考量下 許多國家可能傾向於和此類主體建立實質關係,此部分的研究預計檢驗未被承認之國際法主體在不承 認國國内法下享有何種地位及權利義務,相關之外交實踐亦會納入研究範圍内。 計晝第二部分的研究重點則為未被廣泛承認國際法主體與政府間國際組織的關係,許多國際組織的會 籍均限於國家,而此類主體在國際組織的參與經常遭遇困難,但實踐上仍有不以國家資格為前提的會 籍規定或參與方式,此部份的研究因此從各組織憲章及其他會員相關規定出發,並觀察過去未被廣泛 承認國際法主體與各組織的互動,以了解此類主體參與各組織及其事務的空間。 計晝結論將歸納未被廣泛承認國際法主體與不同國家與國際組織的互動情形,包括它們在各國國内法 的地位及權利,和是否及如何能成為各國際組織會員,與是否及如何能以非會員身分參與各組織會議 及事務。並希望基於這兩部分的研究成果,提供我國加強與他國關係以及增進國際組織參與的策略建 議。
The issue of recognition closely relates to the determination of statehood and international legal personality. Traditionally, two theories have been the focus of discussions: the constitutive theory and declaratory theory. A survey of literature and State practice appears to indicate prevalent support of the declaratory view, arguing that a new State is created when the factual conditions are in conformity with the requirements of statehood, and the recognition of other States merely serve as acknowledgement of the fact. In reality, entities without general international recognition often encounter difficulties when attempting to engage in relations with other States or to participate in inter-governmental organizations. Against this background, this project aims at studying the status of unrecognized subjects in contemporary international law, and to this aim, two approaches are taken. Firstly, this project looks at the status of such subjects in the domestic legal systems of select States, including Poland, the United States, the United Kingdom, etc. Although such subjects are usually not treated in the same manner as States in the domestic legal systems of State who have not recognized them, arraignments are often made to ensure that the lack of recognition does not bar the establishment of semi-official or unofficial relations between the entities and the non-recognizing States. In this respect, domestic laws and regulations regarding status and rights and obligations of such subjects as well as relevant jurisprudence and diplomatic practice will be taken into consideration. The second focus of the project concerns the status of unrecognized subjects vis-a-vis select inter-governmental organizations and their participation therein. Memberships of inter-governmental organizations are generally open to States, but practice has seen exceptions of participation of entities with disputed statehood, albeit not necessarily in the capacity of full members. To properly understand the interactions between international organizations and unrecognized subjects, the constituent instruments of each international organization and internal rules regarding membership and non-member participation will be explored. Additionally, past (successful and unsuccessful) attempts of unrecognized subjects to apply for memberships or to participate in the international organizations will be examined, and it is envisaged that such an examination will shed a light on the matter and contribute to the comprehension of the operation of international organizations in this regard. It is the hope of this project to, through studying the status of subjects not generally recognized as States from these two perspectives, formulate suggestions for strategies for the Republic of China to strive for stronger relations with other States and wider and deeper participation in international organizations.
