題名 德國之法學教育與法官之養成
Legal Education in Germany and the Training of Judges

摘要 德國傳統大學法學教育,以培養學生通過國家考試擔任法官作為目標,並以國家考試通過作為法學教育的終點,其教育與考試的內容,包含了理論學習及實務訓練兩方面。2002 年改革之後,法學教育與國家考試又更擴大面向至律師等其他法律專業工作,且不再堅持以通過兩次國家考試,成為完全法律人作為法學教育的目標。然而,德國法學教育理念、課程安排與國家考試仍然相互牽動,並維持法官養成的嚴謹度,此點值得同屬歐陸法系的我國作為比較並參考。
The traditional legal education in Germany aims to prepare students for becoming judges through the national examination. Passing the national examination serves as the endpoint of legal education, with curriculum encompassing both theoretical learning and practical training. After reforms in 2002, legal education and the national examination expanded to include other legal professions, such as lawyers, and no longer strictly adhered to the goal of producing fully qualified legal professionals solely through passing the two stages of the national examination. The educational philosophy, curriculum structure, and the national examination continue to be closely intertwined, maintaining a rigorous standard for the training of judges. This model is worth considering for countries with a civil law legal system, like ours.
