| dc.description.abstract (摘要) | 「非市場經濟」之國內價格或成本在反傾銷程序中不適合做為正常價值基礎,早已於GATT 第6.1 條增補解釋規定有所認知,因而允許GATT 締約成員以替代國之價格或成本為基礎進行價格比較。然而該增補解釋所規定之要件並無法涵蓋「轉型中經濟」,如何處理後者之國內價格或成本在反傾銷程序中亦有可能不具價格可比性之問題,即成為中國、越南此類「轉型中經濟」加入WTO 時需解決之課題。中國入會議定書第15 條賦予WTO 成員在GATT 第6.1 條增補解釋外,另外使用替代國價格或成本之權利。然而隨著此類規定內建的落日期限屆至,未來WTO 成員應如何決定中國國內價格之可比性,遂成為爭端解決之難題。本研究分析此類裁決之論理,一方面對其所形成之WTO 法理進行批判,另一方面評估WTO 成員未來對此類經濟體之不公平貿易是否仍可以有效對抗,最後並對我國相關法制與實務是否需加以因應修正,做出結論。 | |
| dc.description.abstract (摘要) | It is well recognized in the second Ad Note of GATT VI:1 that non-market economies’ domestic prices or costs may not be appropriate as the basis of normal value for strict price comparison in antidumping procedures. Accordingly it is allowed to use surrogate country’s prices or costs for price comparison. Nevertheless, the second Ad Note of GATT: VI:1 cannot cover the economies in transitions due to its strict definition of non-market economies. How to deal with the price comparability of economies in transitions became one of the issues required to be resolved in China’s and Viet Nam’s WTO accession. Paragraph 15 of China’s Accession Protocol grants WTO importing members a right to use surrogate country’s prices or costs in addition to the existing exceptions under the second Ad Note of GATT: VI:1. With the sunset of paragraph 15 of the China’s Accession Protocol, how to determine the price comparability for Chinese dumped imports after 2016 becomes the one-billion dollar question for the WTO adjudicating bodies. This study analyzes the reasons of the aforementioned adjudication. On the one hand, it provides a critical view of the jurisprudence formatted through the above adjudication; and on the other hand, it evaluates the effectiveness of measures left to WTO members after such adjudication against unfair trade practice of economies in transitions. In conclusion, the study will suggest whether Taiwan’s relevant antidumping rules and practices against economies in transitions need to be adjusted. | |
