題名 排放權交易制度連結之法律議題分析
Legal Analysis on Linking Emissions Trading System

摘要 排放權交易制度逐漸為各國使用做為溫室氣體減量的管制工具,考量到市場運作之效率,不難理解實施排放權交易制度的國家或區域,欲透過連結其他制度以擴大排放權交易的市場,增加此一市場的規模以及流動性。此外,排放權交易制度連結的地區越廣泛,碳溢漏發生的機率越少,所帶來的環境益處也越高。因此,目前已經有一些排放權交易制度連結的案例(例如歐盟與紐西蘭允許受管制者使用京都議定書下的清潔發展機制計畫所取得的「經認證的排放單位」、加州與魁北克的排放上限與交易制度的雙向直接連結),也有更多預計連結排放權交易制度的規劃。決定是否要與其他排放權交易制度連結、所選擇連結的對象、以及連結的型態,均是各個排放權交易制度的建構者必須做出的政策與政治決定,於做出相關的決策前,各種選項中所涉及的法令配套、甚或是有哪些法令面的規範會限制了可選擇的選項,均是決策者必須要事前加以評估的要素;此外,一旦做出決策後,法令上的配套,包括建立排放權交易制度的授權法令之訂定或修改、以及涉及連結的對外合作文書(條約、備忘錄、意向書等等),例如若透過簽訂條約的方式進行,此類的條約內容可能包括哪些議題、以及此類的文件在國際法下的意涵,也是影響連結是否得進行、以及後續運作是否順暢的關鍵。故,於研究排放權交易制度的連結時,法律面的分析—包括內國法制的對應設計、以及於國際法上之意涵—即相當重要,此即是本研究計畫所欲進行的研究課題。
Emissions trading have been widely used by countries, sub-national entities, and regional organisations to reduce GHGs emissions. Linking different emission trading systems can improve market efficiency by facilitating cost effectiveness and increasing market liquidity. By expanding jurisdictions that regulate GHGs emissions via linking also reduce incidences of leakage. These are the reasons why linking between or amongst emissions trading systems are taking place more frequently, and are being contemplated by emerging emissions trading system. Whether to link with other emissions trading systems, or the types of linkages that are chosen might be political decisions that need to be made by policy-makers. However, legal issues involved in linkage are important background information for decision makers before such decisions are reached. Furthermore, once decisions on linkage are reached, implementing such linkage will require corresponding legal preparation, including internal and external. In the case of the former, legislation, be it national, sub-national, or regional, authorising and supervising the operations of the respective emissions trading system will need to incorporate elements implementing the linkage. In the case of the latter, formal arrangement, be it formal treaty or informal political arrangement or memorandum of understanding, might need to be negotiated between or amongst jurisdictions in case of two-way (bilateral or multilateral) direct linkage. In addition to the substantive contents contained in such arrangement, what is the status of and how to characterise such arrangement under international law will also affect the operation of linkage via such arrangement. All these legal issues, national and international, play a key role in the design and operation of linking emissions trading system. Thus, this research project will focus on these legal issues on linking emissions trading systems.
