| dc.description.abstract (摘要) | 市場機制在國際環境法下,並非廣泛的為各類的國際環境公約所運用,除了在國際氣候變遷管制體系之下:京都議定書與巴黎協定均賦予締約國透過市場機制的運用,來達成其於條約下的減量承諾。依據京都議定書第二條第二項的規定,對於來自國際航空以及國際海運之溫室氣體(greenhouse gases,GHGs)排放,應分別透過國際民航組織(International Civil Aviation Organization,ICAO)以及國際海事組織(International Maritime Organization,IMO)進行管制,也就是在國際氣候變遷管制體系下運用廣泛的市場機制、以及相關的法律規範與制度設計,並不適用於來自國際航空以及國際海運的GHGs排放管制上。來自國際航空與國際海運的GHGs 排放,佔全球之GHGs 排放均少於3%,但其成長的速度都相當快,因此,ICAO 以及IMO 是否遵循國際氣候變遷管制體系的發展,將運用市場機制/市場導向措施(market-based measures,MBMs)作為主要的管制工具?在ICAO 於2016 年第39 屆大會,決議通過成立適用於國際航空之GHGs 排放管制的「國際航空碳抵銷與減量機制」後,國際航空運用MBMs 的趨勢很明顯,但截至目前為止,IMO 是否將運用MBMs 作為管制國際海運的GHGs 排放,態勢尚未明朗。本研究計畫預計針對適用於、或可能適用於國際航空業以及國際海運之GHGs 排放管制的MBMs,觀察在ICAO 以及IMO 下的發展,並據此,從制度設計面以及法規範形式,針對運用於GHGs 排放減量的市場機制(以排放權交易為主),在國際氣候變遷管制體系下、國際航空、以及國際海運之發展與適用,進行比較,進一步就此一比較的結果,探討市場機制於國際環境法下的運用趨勢。 | |
| dc.description.abstract (摘要) | Market-based mechanisms are not a prevalent policy tool under international environmental conventions, except under the international climate change regime. Both the Kyoto Protocol and the Paris Agreement offer market-based mechanisms as a flexible tool for their parties to implement their GHGs reduction pledges under the treaty regime. Article 2.2 of the Kyoto Protocol stipulates that GHGs emissions from aviation and marine bunker fuels should be regulated through the International Civil Aviation Organisation (ICAO) and the International Maritime Organisation (IMO), respectively. This means that market-based mechanisms under the international climate change regime are not applicable to regulate GHGs emissions from international aviation and international marine transport/shipping. GHGs emissions from these two sectors represent, respectively, less than 3% of the global GHGs emissions. However, their respective growth is both projected to be very high. Will the experiences in the international climate change regime in using market-based mechanisms to regulate GHGs be applicable to regulate GHGs emissions from international aviation and international shipping? The ICAO, in its 39th Assembly meeting, finalised the “Carbon Offsetting and Reduction Scheme in International Aviation”. This means that market-based measures (MBMs) will become one of the policy tools to regulate GHGs emission from international aviation under the auspice of the ICAO. On the other hand, whether IMO will adopt MBMs to regulate GHGs emissions from international shipping remains unclear. This research project undertakes to follow the development of MBMs (focusing on emissions trading) under both the ICAO and IMO, with a focus on their institutional design and legal form. Based on these research findings, this research project will conduct a comparative analysis on how MBMs are designed and regulated under the international climate change regime, international aviation, and international shipping. Through this comparative analysis, this research project intends to examine the role and trend of market-based mechanism as a policy tool under international environmental law. | |
