Da-Li Yuan;Criminal judgement;Ping-Cheng Yuan;Civil judgement;Early Republican China;Judicial documentation日期 1999 上傳時間 18-Apr-2007 16:51:52 (UTC+8) Publisher 臺北市：國立政治大學法律學系 摘要 民國初期(1912-1928)的法制歷史,囿限於種種因緣,無論台灣、中國大陸或海外,幾為法制史研究上的空白。尤其,有關司法檔案的整編與研究,更付闕如。惟此時期的司法文獻與民國以來的法制關係密切,要探討過往的法制事件,依靠的是史料,而史料之中又以檔案為原始資料,最為可信,最彌足珍貴。 有關民初的司法檔案,實即指北洋政府中的司法部、大理院、京師高等審判廳、總檢察廳及平政院等文獻史料。本計畫所側重者是大理院的刑事判決,以及平政院的行政訴訟裁決。其中,大理院是北洋政府時期的最高司法審判機關,成立於民國元年,迄於民國十七年。該時期的判決與解釋例,在當時與後世皆具權威性及影響力,在中國近代法制變革中兼含歷史與時代意義的雙重價值。而成立於民國三年以迄十七年的平政院,則是中國受理行政訴訟的伊始。 民初時期的司法檔案史料,目前均藏置於南京「中國第二歷史檔案館」,管制甚嚴。如何設法透過各種可能途徑,蒐集其中重要原檔案影印資料,是困難之事。尤其,對於龐雜的史料,如何彙編整序以及精選疏釋,深入探討,更是一大難題。因此,在研究順序方面,特重以下三個階段:(1)司法檔案資料之蒐集與選擇,(2)資料之精選與個案整理分析,(3)法史學上歷史及時代意義之疏釋與評價。 本研究計畫全程原規劃分為五年期,本年度係屬第二年。
The purpose of this program is to study the legal history at the earliest days of the Republic of China (1912-1928), especially, judgments of Dal Li Yuan period. By way of investigation, these files are stored up at The Second History File Hall of Nanking that difficult to collect them. Another the total file are 15674 volumes which original documents by saved, not easy to arrange, comment and analyze. In respect of program procedure that focus on three stage as follows: (1) collect and choose. (2) pick the best and analyze the data. (3) interpret and evaluate for legal history.關聯 行政院國家科學委員會
