題名 全球治理運作模式之研究：以締約關係途徑分析《京都議定書》個案為例

摘要 受到全球化與治理雙重影響，原本侷限於國家範圍內由上而下的政府統治形式乃因勢而為，朝全球治理形式轉化，也就是跨越國家疆域與公、私部門界限的共同合作漸漸成為一種普遍的現象。本論文試圖從理論基礎著手，確立全球治理的運作階段，以建構一套能夠解釋全球治理實務現象的運作模式。
本論文第一章為導論，說明本論文的研究動機、目的、途徑、方法、程序與分析架構等要項。同時，本論文檢視各類全球政治、經濟、社會與文化治理等議題的個案後發現，儘管它們至關重要，但是以影響人類的深度、廣度以及時間長度而言，都無法與全球環境治理議題相提並論。畢竟環境一旦遭受破壞，往往導致永久性的生態浩劫，不是難以拯治，就是拯治的過程曠日費時，其成果也極為有限，最後受害的將是人類全體。特別是因工業發展與經濟成長產生的溫室氣體濃度愈來愈高，此種因溫室效應而導致的全球暖化現象，成為近年來聯合國大會中廣受關注的焦點。《京都議定書》的出現，不啻為當前拯治全球溫室效應的努力，邁出關鍵的一大步，因此本論文乃選擇《京都議定書》，作為全球治理運作模式擬驗證的實證個案。
第二章從全球治理的概念與全球治理的運作模式等兩方面檢閱相關研究文獻，以選擇最為滿足全球治理活動構成要件的全球治理運作模式，作為本論文研究全球治理運作模式的理論基礎。詳言之，本章有系統地檢閱當前與全球治理相關的研究文獻，從中挑選出涵蓋範圍最為全面、分析觀點最為深入、影響層面也最為豐富的全球治理概念，並歸納出全球治理活動的構成要件。其次，再從研究文獻□選擇最為滿足這些要件的全球治理運作模式，作為本論文擬採用的理論基礎，藉此確立全球治理的運作階段，以建構一套能夠解釋全球治理實務現象的運作模式。在文獻檢閱的過程中，評析各類文獻的貢獻與缺失，並就相關主題構成一個論述的系絡，使其對全球治理主題的瞭解有適當的深度。
第三章探討第二章所選擇的的理論基礎，並據此確立全球治理的運作階段，以產生對《京都議定書》個案的預期發現。詳言之，在第二章的文獻檢閱中業已選擇了最能符合全球治理活動構成要件的締約關係途徑，作為本論文研究全球治理運作模式的理論基礎。本章介紹締約關係途徑的理論背景與意涵，並據此確立全球治理的運作階段，以產生對《京都議定書》個案的初始預期發現。
第四章根據政策分析的過程，進行對《京都議定書》個案的內容析述。詳言之，如以《京都議定書》個案為例說明唐恩以問題為中心的政策分析論述，則《京都議定書》的締結事實上可被視為是為解決溫室效應此一全球環保政策問題，而在全球（溫室效應類）環保政策制訂過程中被建議、採納並執行的政策行動，故該論述實有助於對《京都議定書》個案從議程設定、政策規劃、政策採納發展到政策執行程序的分析闡述（由於《京都議定書》甫於二OO五年二月十六日生效，故還未發展到政策評估程序）。有鑑於此，本章遵循唐恩以問題為中心的政策分析過程，進行對《京都議定書》個案發展經過的析述。
第五章將締約關係途徑與《京都議定書》個案進行理論與實證的交互檢證，並據此修正全球治理的理論基礎與運作階段。詳言之，本章以第三章第二節雷克所提出的談判、行動者的多樣性、剩餘控制權利、治理與締約、無政府階層-政府階層關係的連續體與全球治理結構調適的交易成本觀點等締約關係途徑的六項要素為基準，將締約關係途徑與《京都議定書》個案進行理論與實證的交互檢證，藉以建構一個整合性的全球治理運作模式。
第六章根據第五章的檢證結果，建構出一個整合性的全球治理運作模式，以歸納出本論文的諸項結論，並對未來的理論與實證層面提供建議。詳言之，本章根據第五章的檢證結果，建構出一個整合性的全球治理運作模式，以歸納出對全球治理所產生的意義，並對未來全球治理的理論與實證層面提供建議。

dc.description.abstract (摘要) 受到全球化與治理雙重影響，原本侷限於國家範圍內由上而下的政府統治形式乃因勢而為，朝全球治理形式轉化，也就是跨越國家疆域與公、私部門界限的共同合作漸漸成為一種普遍的現象。本論文試圖從理論基礎著手，確立全球治理的運作階段，以建構一套能夠解釋全球治理實務現象的運作模式。
本論文第一章為導論，說明本論文的研究動機、目的、途徑、方法、程序與分析架構等要項。同時，本論文檢視各類全球政治、經濟、社會與文化治理等議題的個案後發現，儘管它們至關重要，但是以影響人類的深度、廣度以及時間長度而言，都無法與全球環境治理議題相提並論。畢竟環境一旦遭受破壞，往往導致永久性的生態浩劫，不是難以拯治，就是拯治的過程曠日費時，其成果也極為有限，最後受害的將是人類全體。特別是因工業發展與經濟成長產生的溫室氣體濃度愈來愈高，此種因溫室效應而導致的全球暖化現象，成為近年來聯合國大會中廣受關注的焦點。《京都議定書》的出現，不啻為當前拯治全球溫室效應的努力，邁出關鍵的一大步，因此本論文乃選擇《京都議定書》，作為全球治理運作模式擬驗證的實證個案。
第二章從全球治理的概念與全球治理的運作模式等兩方面檢閱相關研究文獻，以選擇最為滿足全球治理活動構成要件的全球治理運作模式，作為本論文研究全球治理運作模式的理論基礎。詳言之，本章有系統地檢閱當前與全球治理相關的研究文獻，從中挑選出涵蓋範圍最為全面、分析觀點最為深入、影響層面也最為豐富的全球治理概念，並歸納出全球治理活動的構成要件。其次，再從研究文獻□選擇最為滿足這些要件的全球治理運作模式，作為本論文擬採用的理論基礎，藉此確立全球治理的運作階段，以建構一套能夠解釋全球治理實務現象的運作模式。在文獻檢閱的過程中，評析各類文獻的貢獻與缺失，並就相關主題構成一個論述的系絡，使其對全球治理主題的瞭解有適當的深度。
第三章探討第二章所選擇的的理論基礎，並據此確立全球治理的運作階段，以產生對《京都議定書》個案的預期發現。詳言之，在第二章的文獻檢閱中業已選擇了最能符合全球治理活動構成要件的締約關係途徑，作為本論文研究全球治理運作模式的理論基礎。本章介紹締約關係途徑的理論背景與意涵，並據此確立全球治理的運作階段，以產生對《京都議定書》個案的初始預期發現。
第四章根據政策分析的過程，進行對《京都議定書》個案的內容析述。詳言之，如以《京都議定書》個案為例說明唐恩以問題為中心的政策分析論述，則《京都議定書》的締結事實上可被視為是為解決溫室效應此一全球環保政策問題，而在全球（溫室效應類）環保政策制訂過程中被建議、採納並執行的政策行動，故該論述實有助於對《京都議定書》個案從議程設定、政策規劃、政策採納發展到政策執行程序的分析闡述（由於《京都議定書》甫於二OO五年二月十六日生效，故還未發展到政策評估程序）。有鑑於此，本章遵循唐恩以問題為中心的政策分析過程，進行對《京都議定書》個案發展經過的析述。
第五章將締約關係途徑與《京都議定書》個案進行理論與實證的交互檢證，並據此修正全球治理的理論基礎與運作階段。詳言之，本章以第三章第二節雷克所提出的談判、行動者的多樣性、剩餘控制權利、治理與締約、無政府階層-政府階層關係的連續體與全球治理結構調適的交易成本觀點等締約關係途徑的六項要素為基準，將締約關係途徑與《京都議定書》個案進行理論與實證的交互檢證，藉以建構一個整合性的全球治理運作模式。
