摘要 資訊傳播時代,隨著全球化與數位匯流的趨勢,媒體、電信與資訊網路整合下的大型企業掌控越來越大的市場比例。不過由於近年來自由競爭的經濟理論取代各國管制規範,加上資訊傳播的產品與地理市場定義不清,業者普遍認為高科技產業具有資本密集與高競爭的特性,無需政府介入過多,使得對於是否應該執行反托拉斯法,規範資訊傳播匯流的市場結構與競爭行為,以達到促進產業競爭的功能產生了疑問?
     
     本研究不著重在法條上的詮釋,而是透過討論過去台灣與美國關資訊、傳播與電信在跨產業併購與違反競爭行為的例子,並深度訪問了三位公平交易委員會委員與二位實際參與公平交易委員會運作的學者,了解台灣與其他國家在處理相關問題的準則,重新思考反托拉斯法在實際應用於促進市場競爭上的優勢與限制,並提出具體建議。
The antitrust law has been used to maintain the market competition for over one hundred year. However, in the age of media and information convergence and globalization, product and geographic markets are hard to define. In addition, the industries believe that the information and media markets are high capital investment and competition from the new entries. Therefore, they do not think the government should apply the antitrust law to sustain the competition.
     
     Unlike previous studies focusing on the explanation of the law itself, this research proposal will review Taiwan and US related cases to understand the principles of the antitrust applied to the media and information markets. It hopes to rethink the role of the antitrust law and to find a way to maintain the competition in the globally information and media age.
