| dc.description.abstract (摘要) | 本計畫以三年的時間，實作一項網路治理平台，並運用在性騷擾規範的形成之上。國內最近出現法官判決性騷擾的個案，以強吻的時間等因素，判斷性騷擾是否成立。正反映申請人過去數年在貴會補助下，所進行一系列理論及制度面研究，所指出現今法律所需要的新典範，是正視國家法律形成，以及社會機制，透過對話形成規範二者並重，以及重視二者之間互補的新典範。本研究一方面將實作一網路治理平台，並且以性騷擾為例，實際運作此一網路治理平台。另外本計畫也將持續過去數年的研究成果，繼續探索新典範的法律概念課題。申請人此一理論部分的研究，以希臘柏拉圖正義理論及其統一性; 亞里斯多德將正義二分為交換正義與分配正義，及所受到的批判為核心，進一步思索上一年度所發展出德握金原則社群的理論及補強課題。 | en_US |
| dc.description.abstract (摘要) | For the next three years, this project will develop an internet platform for governance, and used in the derivation of sexual harassment public norm in Taiwan. Recent court decision in Taiwan causes social controversy, because judge uses how many seconds defendant kisses the plaintiff to decide whether sexual harassment can be established. Such controversy indicates what I developed in the past few years, under the sponsorship of National Science Council, which we need to accept the importance of the existence of both national law making and social norm derivation through dialog; and their complementary relationship. The related theoretical research will also investigated in the following three years. Building on top of my previous research, I will investigate the theory of justice of Plato, especially the unity of such theory; and the theory of distributive and corrective justice developed by Aristotle, and its criticism. This investigation will serve as the basis for further questioning the idea of community of principle developed by Dworkin. | en_US |
