摘要 「國家擔保責任」(Gewährleistungsverantwortung des Staates)為現代國家角色與任務變遷下,在國家學與行政法學領域中漸受重視之一種新興責任態樣。其理論基礎乃源自於「擔保國家」理念,並與全球化、私人化、公私協力等行政革新議題息息相關。質言之,其所指涉之內涵,乃為國家在行政任務之實踐上,由「給付者」之角色,變遷到「擔保者」之地位;國家所擔負者,不再是自為供給與履行人民生存照顧所需服務,毋寧透過法規框架之建制以及行政管制手段之投入,形塑私人執行公共任務時,服務品質、消費者保障,以及公共福祉等法益,亦得如同國家自為給付時獲得相同水準,甚至更高效能之保障。基此,在我國大量推展公私協力方案之現今,對於國家擔保責任之理論內涵與實踐,應屬須受正視之重要公法學議題。本研究計畫擬以兩年為期,深入探討「國家擔保責任」在現代國家任務變遷與管制革新氛圍下之法理基礎與實踐情況。其中,第一年之研究議題將環繞在擔保國家理念之形成與思想基礎、國家擔保責任在國家學與憲法學上之理論依據、國家擔保責任之內涵,以及實現之手段與在行政法上可能之開展方式。研究素材則聚焦於德國國家學、公法學,以及管制理論等領域之相關學說與討論。至於第二年之研究議題,則是根植在第一年所為「基礎理論面向」研究成果的基礎上,從「實證面向」分析國家擔保責任在我國現有民間參與公共建設案例中之具體化呈現方式,以及衍生之相關促參法上問題。對此,台灣高鐵公股董事增席案、台北小巨蛋市府接管案,以及阿里山森林小火車BOT 由台鐵接管經營案,皆屬我國在民間參與公共建設實務上,面臨民間廠商經營困境時,國家擔負其擔保責任之具體展現。惟此等擔保措施在法治國家以及擔保國家理念上應為如何之評價?其所衍生之法律關係如何?是否具有手段目的上之合比例性?何時將遭受到擔保責任之界限?凡此問題,皆屬本研究計畫第二年擬欲探討之客體。本研究計畫之預期目標,乃希望能為「公私協力結果法」填補並深拓國家擔保責任之理論基礎與法制建制,俾使民間參與公共建設法制更臻完善。
The guarantee responsibility of the state (Gewährleistungsverantwortung des Staates) is a new form of responsibility that is highly thought of in the field of social sciences and administrative law studies in modern countries. The guarantee responsibility of the state is related to globalization, privatization and the Public-Private Partnerships. It means that the state becomes a guarantee rather than a provider on the administrative duties. The state no longer provides the duty of care to the people. By constructing law frames and administrative restricting limits, the state allows private enterprise or civilians to operate public tasks. The legally protected interests of service quality, consumers ensure and public welfare might even surpass those offered by the state. Therefore, the theory and practice of the Responsibility of the state to the guarantee should be emphasize on vital public law issues due to the mass promote of public-private partnerships in our country nowadays. The two year research project of mine will mainly study on the implement and basic theory of the Responsibility of the state to the guarantee in modern countries. The research topic for the first year will mainly focus on subjects such as, the formation and cerebration of the state to guarantee concept, the theory of the guarantee responsibility of the state on social studies and constitutional studies. The measures to carry out the guarantee responsibility of the state under the regulation of administrative law will also be discussed. The research materials will focus on German public law. The second year research will confirm the actual example of the guarantee responsibility of the state carried out in the private participation in infrastructure projects and the related issues of BOT regulations. Issues like the Taiwan high speed Rail Company’s government share director arrangement case, the Taipei Arena taking over by the city government’s case and the BOT case of Alishan train taking over by the Taiwan railway. The cases mentioned above are all related to the failure of private participation in infrastructure projects and how the guarantee responsibility of the state works afterwards. But how does the guarantee responsibility of the state really execute under the structure of countries ruled by law? How do we evaluate the concept of state guarantee? What is the connection between law and the guarantee responsibility of the state? Does the guarantee responsibility of the state fit in to the concept of proportionality? When will the state of guarantee be limited? The questions mentioned above are the subjects to be researched in the second year. The aim of this research project is to resupply and develop the theory basis and law construction for the Public-Private Partnerships law. By achieving this aim, the law construct for the civil participation in public construction will be second to none.
