題名 私法自治的界限─「內容違法」專用權約定的探討

摘要 私法自治的界限─「內容違法」專用權約定的探討查公寓大廈共用部分經約定得供特定區分所有權人使用,公寓大廈管理條例第三條第五款訂有明文。故專用權之約定,不啻亦為私法自治的體現。惟公寓大廈管理條例第九條第三項復又規定:專用權之約定不得違反公寓大廈管理條例、區域計畫法、都市計畫法及建築法令。易言之,約定專用權之自由,尤其是專用權之「內容」,受前揭法規之限制;前揭法規,可謂為一種私法自治之界限。本計畫將搜集各級法院有關「內容違法」專用權約定的判決,加以整理、歸納。以審視我國法院對「內容違法」專用權約定的判斷原則,進而探求違法專用權約定之類型及內容,具體勾繪私法自治之界限。
The boundary of private autonomy─A research into the exclusive right agreement on common areas in comdominium Though the Condominium Regulation Act is in force for more than 17 years. The issues concerning the exclusive right agreement on common areas are rarely the focus of academic attention. The exclusive right agreements on common areas embody on one hand the private autonomy. On the other hand, they also face restrictions imposed by other legal regulations. It is therefore quite meaningful to explore how wide the freedom of the agreements on could be, and what is the boundary of private autonomy applying to building condominium.
