| dc.description.abstract (摘要) | 本文試圖探索在創用CC授權的機制下，如何讓歌曲著作可以運用CC的授權，讓非商業的使用者可以自由運用，也能另外授權著作權仲介團體，方便欲用於商業目的使用者取得在商業性用途利用的授權，替廣播電台使用歌曲所發生之爭議找到解決方式，同時也不影響相關著作權仲介團體以及著作權人或創作者的獲利，在保護商業利益以及「調和社會公共利益，促進國家文化發展」之自由與開放精神之下，找到調和的平衡點。根據研究結論，本文認為利用創用CC授權條款，可以降低歌曲的授權交易與宣傳成本，而當欲用於商業用途的使用者或團體想要運用該創作者帶有「非商業性」條款的作品時，也必須與著作權仲介團體洽談商業用途授權使用金，在此種互蒙其利的情況下，因應採用創用CC授權條款著作人的需求，國內著作權仲介團體應可考慮提供不同著作財產權授權契約版本，似無將使用創用CC授權條款的著作拒於門外的理由。 | en_US |
