Chinese legal history;Curriculum and teaching;Mainland China日期 1994 上傳時間 2-Sep-2014 09:01:32 (UTC+8) 摘要 本研究按預定計畫,完成以下的三個工作項目。 第一,建立大陸地區《中國法制史》課程與教學之有系統而完整之資料:(1)《中國法制史》之教科書與參考書共計125本。(2)一百五十四人之有效問卷與無效問卷。 第二,與台灣地區的我方比較,大陸地區《中國法制史》課程與教學之優缺點如次: 課程:普遍開設,必修,但若干非係法科之系也同樣開設,則不無可議。 師資:人數眾多,陣容龐大,但素質不齊。 教材:(一)優點:(1)古為今用,(2)秦漢法制史料的出土與研究,(3)中共革命法制史料的整理與研究。(二)缺點:(1)偏執的指導思想與方法,(2)僵化的理論體系,(3)為共黨政權服務的目的,(4)不確定的內容,(5)理倫價值的貧乏。 第三,未來之預料:(1)對《中國法制史》課程與教學的繼續重視,(2)意識型態的開始鬆動,(3)《秦漢法制史》與《中共革命法制史》研究的領先。 謹建議:(1)加強《中國法制史》之課程與教學,(2)加強《秦漢法制史》與《中共革命法制史》的研究。
This paper is an empirical study on 《The Curriculum and Teaching of the Chinese Legal History in Mainland China》. There are three items have been finished as in the following. Firstly, the materials of the topics have been collected and put in order. Secondly, the advantages and disadvantages respectively are: Curriculum: 《The Chinese Legal History》 is a very common required course in colleges and universities in Mainland China. In some cases, the course is being offered even outside law schools. Faculty member: numerous but their background and training vary to a significant degree. Text books: (1) Advantages: ？ Made use of the legal history to the present reform. ？ The rich supply of legal documents and materials of Chin and Han Dynasties uncovered. ？ The research on 《The Legal History of the Chinese Communist Party Revolution》 is another important area of study in which Taiwan lags behind. (2) Disadvantages: ？ biased ideology, ？ inconsistencies, ？ a minimum of theoretical interpretation, ？ researches for political purposes of the Chinese Communist Party. Thirdly, the paper looks into the future of 《The Curriculum and Teaching of the Chinese Legal History in Mainland China》 by predicting that: (1) There will be a continued emphasis on this course. (2) There will be a loosening of the ideological control from the government on academic researches. (3) Mainland China will still take the lead in the study of the legal history of Chin and Han Dynasties.關聯 行政院國家科學委員會
