| dc.description.abstract (摘要) | 由於世界貿易組織（World Trade Organization，以下簡稱WTO）涉及服務貿易之用詞常具有專門性與技術性，為使立法之本旨及其真義充分表現，服務貿易總協定（General Agreement on Trade in Services，以下簡稱GATS）遂分別於第一條及第二十八條規定釋義條文及用詞定義。本文以第一條及第二十八條規定為中心，探討有關GATS適用範圍與相關定義。繼前言之後，本文第二章分析適用GATS之措施，包括措施之定義、措施之內容、採行措施者之範圍、影響服務貿易措施之意義、影響服務貿易措施之調查事項及方式、併予適用GATS及GATT之措施、司法及行政協助之措施、影響某些自然人入境提供服務之措施、有關社會福利之措施等。第三章討論適用GATS之服務貿易，包括服務貿易涉及之定義、提供服務之模式、電子服務之適用範圍、提供服務之自然人的範圍。第四章探究適用GATS之服務，包括服務之項目、不適用GATS之服務。第五章論述非政府組織及個人在GATS上之地位。最後並提出結論。 | en_US |
| dc.description.abstract (摘要) | In order to clarify various complex and complicated terminologies used in the General Agreement on Trade in Services (GATS), Articles 1 of GATS regulates “scope and definition,” whereas Article 28 contains detailed “definitions.”\\rThis paper discusses and analyses the legal dimension of scope and definition of GATS. After the introduction, the second section deals with the measures of GATS, including, inter alia, the definition of measures, scope of measures, measures by members, and the meaning of measures affecting trade in services. This section also tries to answer controversial questions, such as how to determine whether or not a measure affects trade in services, whether measures can co-exist in both GATT and GATS? Section 3 goes through definitions of trade in services, including the supply of a service through four different modes, and the application of GATS to electronic commerce. Section 4 discusses the service sectors applicable in GATS stipulated in both W/120 and UN CPC. Service supplied in the exercise of governmental authority is also analyzed. Section 5 discusses what non-governmental organizations (NGOs) and individual persons could contribute in the operation of GATS. | en_US |
