| dc.description.abstract (摘要) | 基於「國土復育不應只是對於土地之自然條件和物理性質的恢復，而應該成為一個 國家和原住民族之關係以及人和土地之關係的重建行動」的觀點，本計畫之研究將對台 灣本土產生的各種傳統領域調查、部落地圖繪製工作進行有系統地回顧與方法論分析， 釐清不同調查方法與調查程序下所產生之調查成果的意義，並藉以進行研究設計，對研 究區域內泰雅族傳統領域中之土地自然資源使用機制進行調查，以學術與部落知識主體 間的交互詮釋，分析傳統領域中所涵蓋之不同層次之權利型態，進而探討傳統領域權利 之行使和原住民族自治、國土計畫三者之間的關係，進行在國土架構中落實原住民族之 傳統領域權之相關制度設計，以期創造原住民族發展與國土利益平衡之雙贏局面，維護 土地之多元文化價值。 | |
| dc.description.abstract (摘要) | Based on the concept that “the core of national land conservation should be the adjustment of human-land relations, as well as the adjustment of the relation between state and indigenous peoples”, this research will: 1) systematically review the experiences of indigenous traditional territory survey in Taiwan, and develop the methodology to investigate the indigenous mechanism of natural resources utilization in the research area; 2) analyze such mechanism and compare it to modern system of property rights; 3) scrutinize the relations between aboriginal title, indigenous self-governance, and national land planning system, and then make suggestions to the institutional adjustment of related legal structures, so that the indigenous land rights can be realized, and the multiculturalistic value of land can be achieved. | |
