摘要 依據《防止核武器擴散條約》之規定，非核武國家須按國際原子能總署之規約及其保防制度與之協商並締結核子保防協定，以接受核子保防方案，始得獲得核物料進行和平應用。本文研究在於了解我國自1971年退出聯合國及包含國際原子能總署在內之相關機構後，如何透過台美間的核能合作協定，以及台灣、美國與總署間之適用防護事項協定，繼續與國際原子能總署維持核子保防事務的交流，並形塑參與國際核子保防體系之模式，以獲得核物料及相關科技進行和平應用，並一窺我國在國際核子保防體系之法理地位。
According to the Treaty on the Non-Proliferation of Nuclear Weapons （NPT）, each non-nuclear-weapon state to the Treaty shall accept safeguards, as set forth in an agreement to be negotiated and concluded with the International Atomic Energy Agency （IAEA）, to obtain the rights on peaceful uses of nuclear materials. This thesis is aim to understand how Taiwan, after losing its membership of the United Nations and other associated organizations, keeps its exchange with International Atomic Energy Agency （IAEA） on nuclear safeguards affairs and paves the way of participating in the international safeguards system to maintain its right to acquire nuclear materials to conduct peaceful nuclear application, through the Agreement of nuclear cooperation with the United States and the Safeguards Transfer Agreement relating Taiwan, United States and IAEA. Besides, this thesis will also conclude Taiwan’s legal status in the international safeguards system.
