| dc.description.abstract (摘要) | 本研究預計討論各國能源政策與法制與 WTO相關規範之相容性問題。首先，將針 對相關國際間之能源規範加以檢視，並略述在 WTO目前已發生爭端之各國之相關能源 政策或法制。其次，本研究將釐清所有可能適用於跨境能源貨物或服務移動之 WTO相 關規範，並討論前述各國能源政策或法制與 WTO相關規範之相容性。最後，本研究將 從目前已有爭端解決小組報告之加拿大再生能源案出發，綜整目前 WTO相關能源與貿 易之案件，逐一檢視相關政策或法制，以求為我國相關能源政策與法制建立或修改之 參考。 | |
| dc.description.abstract (摘要) | The study is expected to discuss the relevant norms of the national energy policies and norms and their compatibility to WTO. First, it will review relevant international energy regulations, and outline the energy policies or norms of the defendant parties in relevant WTO disputes. Secondly, this study will clarify all the relevant WTO regulations, which may be applied to cross-border energy goods or services, and discuss the compatibility of the aforementioned national energy policies or norms to WTO. Finally, this study will follow the Canada`s renewable energy case, of which the panel report was just issued, and try to synthesize others cases now in WTO relating to disputes between trade and energy on an ad hoc approach. The result of this research may be served as a reference for the establishment or the revision of our energy policy and norm in Taiwan. | |
