嵌入式升級治理日期 2023 上傳時間 1-Sep-2023 15:32:07 (UTC+8) 摘要 歐洲自1957年至今的整合,已發展出歐盟自身一套獨樹一格的治理體系。成員國多樣、發展程度與目標各異,且涵蓋議題廣泛多元,如何尋求彼此間的協調,以及成員國與歐盟之間的關係又該如何平衡,是歐盟成長過程中永恆的挑戰與議題。在此中誕生的多層次治理著重在歐盟、成員國與次國家等多層次成員之間的動態,不論是在經貿、社會政策、教育研究等面向上,多層次的動態網狀結構都能讓我們看到歐盟治理方式中追求共同發展但又尊重各層次自主權的特色。而環境議題不但是歐盟在全球掌握話語權的領域,也是歐盟在全球施展影響力的方式之一,因此分析歐盟內部的多層次環境治理模式,對於了解歐盟便有其重要性。此外,環境政策屬於歐盟三大權限中的輔助原則範圍,成員國的角色必不可少,因此本文以德國作為研究案例,不僅因為是環境政策的領導者,也是次國家成員參與程度較明顯的成員國。本文將焦點著眼於歐盟內部,探討在多層次治理與嵌入式升級的框架下,歐盟、成員國與次國家如何在環境議題中合作與互動,以使歐盟成為全球環境議題公認的領導者。本文舉了五個多層次與嵌入式升級的案例,具體呈現多層次成員互相交流、影響的過程:首先,德國再生能源法以政府直接介入的方式促進國內再生能源的廣泛使用,成為相關領域的領導者;德國能源與氣候綜合計劃則展現了國家層次與超國家層次氣候政策的上傳、下載與知識交流,這兩例具體展示德國的領導作用與歐盟和德國之間政策的學習與轉換;接著,透過嵌入式升級的框架,凸顯次國家層次的角色,以及與國家層次和超國家層次的互動,包括領導者德國城市弗萊堡市、接受德國政府資助的追隨者蓋爾森基興市,以及越過國家層次逕行與城市進行聯繫的市長聯盟。由這五例展現歐盟多層次環境治理中各層次成員的角色以及多層次成員之間的互動,了解歐盟內部在環境議題上的運作模式。 參考文獻 一、中文資料周雨蓁,顏華廷,劉正賢.
