摘要 按土地(不動產)登記制度與人民財產權有密切關係,其對於國家、人民而言,是為重要制度。然而,我國關於現行建築物登記之規定,業經司法院大法官釋字第600號解釋指摘其法律上之問題與缺失。於是,健全我國建築物登記法制,實有其必要性與迫切性。有鑑於此,本研究計畫爰擬以「健全我國建築物登記法制之研究——以區分所有建築物所有權第一次登記為中心」為題,進行學術性之研究,為建構我國區分所有建築物所有權第一次登記法制,提供建言。其主要研究內容如下:一、闡釋土地(不動產)登記制度之基本原理(法理)。二、探究區分所有建築物所有權第一次登記事項之應有內容。三、剖析適用法律保留原則之重要土地(及建築物)登記事項範圍。四、釐清我國現行區分所有建築物所有權第一次登記之法律問題疑義及其改進對策。五、嘗試歸納建構我國區分所有建築物所有權第一次登記法制之應有取向與架構
Land (real estate) registration is closely related to private property right, so it's the most important system for the State and people. However, the existing registration of construction ownership had been argued by the J. Y. Interpretation No 600. As a result, Improve the registration of construction ownership of the legal is necessary and urgent. Therefore, this paper will discuss how to the registration of construction ownership of the legal in Taiwan, and focus on the Initial registration of distinguish construction ownership. The main research contents are as follows: 1, to explain the basic legal principle of the land (real estate) registration. 2, to explore contents of the Initial registration of distinguish construction ownership. 3, to analyze the important matters of land (and construction) registration by the Principle of Reservation of law. 4, to clarify the Initial registration of distinguish construction ownership on the legal issues of doubt and suggestions. 5, to structure the orientation and framework of the Initial registration of distinguish construction ownership
