立法權日期 2012 上傳時間 1-Apr-2013 14:40:36 (UTC+8) 摘要 《邦國論六卷》卷帙浩瀚，是布丹留名於政治思想史之作，其中主權概念的闡述更對現代國家理論建構不可或缺。而布丹在十年前於《理解歷史的簡易方法》中也已經簡要討論過主權概念。兩部著作間的理論連貫性引起某些討論；部分學者認為兩書間理路一致，細節差異微不足道，但也有學者認為《理解歷史的簡易方法》屬於十六世紀憲政主義傳統，《邦國論六卷》中的絕對主義為一理論斷裂的結果。然而檢視十六世紀憲政思想著作後可以發現，其脈絡下的君主，不但受到神法與自然法的限制，更必須遵守政治共同體內之既有法律，無法完全掌握立法權。另一方面，布丹早期雖然認為君主的加冕誓詞，令王國既有法律成為一實在限制，但卻也同意身為立法者的主權君主地位必然凌駕於法律之上，可以視情形廢除、修訂，甚至是頒佈新法。布丹在《邦國論六卷》中，則以釐清法律與契約差異的方式來解決這個理論矛盾，並呈現出與憲政精神截然不同的主權理論：主權者雖然仍要受到自然法、神法以及規範王位傳承的根本法等限制，但以上約束全不構成臣民挑戰君主的理由。布丹的絕對主義傾向，與其說是前後期理論斷裂，毋寧是內部邏輯趨於一致的結果。 參考文獻 一、布丹著作1966 Method for the Easy Comprehension of History, translated by Beatrice Reynolds.
