| dc.description.abstract (摘要) | 隨著網路的發展，網路成為社交、日常生活中必要的存在，在使用網路的過程中，每個人均留下大量且足以完整體現個人特質的數位足跡。然而，很可惜的是，當用戶過世，這些數位足跡轉變為數位遺產後，我國現行法與多數的平台政策，並未具體規範應如何處理數位遺產的問題，將無法應對未來可能產生的相關爭議，亦忽視線上數位遺產的重要性，故有必要建立保障線上數位遺產的制度。而數位時代的來臨，傳統對於隱私的討論，將難以應對現代的發展，而數位遺產的問題，亦涉及逝者的隱私權，故本文除參照美國學理，論證新時代的隱私發展，更將針對逝者的隱私權，參照美國學理與實務，討論死後隱私權的保障基礎，並介紹「數位資產和帳戶受託使用模範法（Revised Uniform Fiduciary Access to Digital Assets Act, RUFADAA）」與州法中，如何處理數位遺產的問題。最後，回歸我國法討論，論證我國憲法上，對於死後隱私權的保障基礎，並應參照美國的模範法，建立規管數位遺產的法制，並提出具體的立法建議，盼於未來得對數位遺產提供完整的保障。 | zh_TW |
| dc.description.abstract (摘要) | With the development of the Internet, it becomes a necessity in our social and daily life. When surfing the Internet, users leave huge amount of digital footprints/digital assets that can reflect their personality traits. When users die, these digital footprints/digital assets are transformed into online digital legacy. However, neither Taiwan’s current law nor most online platforms` policies have provisions regarding how to deal with digital legacy. This situation not only ignores the importance of digital legacy, but also leaves many important issues unregulated. Therefore, it is imperative to establish an effective legal framework to protect online digital legacy.In the digital age, traditional understanding of privacy is difficult to keep up with the newest technology development, and the issue of online digital legacy is an obvious example. By referring to the latest discussion of U.S. theories and practices, this thesis tries to establish a new concept of privacy, and adopts the idea of “post-mortem privacy” as the basis for the protection of digital legacy. In addition, on a more practical level, this thesis introduces and studies the U.S. Uniform Law Commission’s Revised Uniform Fiduciary Access to Digital Assets Act as well as relevant state laws, and how these (model) laws handle the digital legacy issues. Finally, the last part of the thesis turns its focus to Taiwan. It tries to identify the constitutional foundation for post-mortem privacy, and to provide concrete legislative suggestions to regulate and protect digital legacy. | en_US |
